Disputes between joint property owners can arise where one of the co-owners wants to sell the property to realise their interest, but the other does not want to sell because they wish to live in the property.
If the dispute cannot be resolved then it may be necessary to apply to the Court for an order for sale.
It will be important to consider the intention of the parties at the time of purchase, the purpose for which the property is held and, if relevant, the welfare of any child. Where children are involved the position can become much more complicated.
