Legal Disputes Pricing Information

Legal Disputes Pricing Information

TWM Solicitors will provide you with an estimate at the outset of your dispute and explain how best your potential liability in respect of the other party’s costs can be minimised.

Costs

For most clients who become involved in legal disputes, one of their principal concerns is costs. We seek to address the issue of costs with our clients at the outset of a dispute in an honest, straightforward and clear manner.

Our Dispute Resolution team encompasses decades of experience and specialist expertise and we offer top quality services at very reasonable rates, especially when compared to many City-based law firms offering similar levels of expertise. Nevertheless, the cost of court proceedings in particular can be very high and any party to a dispute has to be aware of not only their liability for the costs of their solicitor, but their potential liability for the costs of the other party in the event that they are unsuccessful.

We seek to act proportionately in every case and we believe that it is important to try and achieve a solution to any dispute which will minimise our client’s exposure to costs, while achieving the best possible outcome.

We will provide you with a cost estimate at the outset of your dispute and this estimate will be updated as the dispute proceeds. We will also explain your potential liability in respect of the other party’s costs and how best this potential liability can be minimised, if applicable. We encourage our clients to speak to us openly about costs and funding at all stages.

Funding options

In order to support our clients in pursuing deserving cases, we have a number of funding options which may assist, including:

  • Third party funding
  • Insurance
  • Pay-as-you-go
  • Fixed fees
  • Conditional Fee Agreements (commonly known to as “no win no fee”); and
  • Deferred fee arrangements

TWM Solicitors do not undertake publicly funded work – Legal Aid. The availability of Legal Aid is in any event extremely limited.

Our team will be able to discuss these options with you in more detail if needed.

FAQs

Unfortunately we do not. The scope of Legal Aid for civil disputes is now virtually non-existent and we do not offer any form of Legal Aid services.

Every dispute is unique and costs will always differ from case to case. The are always factors to a dispute which will make it hard to predict costs with accuracy, including the actions and attitude of the other party to the dispute. However, in every case we will aim to provide you with the best possible information on costs at each stage including as part of our initial analysis of your enquiry.

In some cases, yes – but in almost every case you will only recover a percentage of the costs you actually pay out (for example, 60% of the costs you pay out). The rules and procedures regarding costs are complex and we will explain them to you in more detail as your dispute progresses. However, in disputes that reach a Court, the general rule is that the “loser” pays some, if not all, of the “winner’s” costs.

The short answer is yes, probably. In disputes that reach a Court, the general rule is that the “loser” pays some, if not all, of the “winner’s” costs – though the “winner” will never recover 100% of what they have paid in costs.

This varies in every case but can include Court fees, fees of a barrister, fees of experts or professionals (if they are needed) and Land Registry fees.

Yes, all of our fees are subject to VAT at the standard rate. There are some limited exceptions to this rule if you live outside the UK.

Most of our work is charged on a “time spent” basis with reference to the hourly rates of the members of our team who work with you on your dispute. We will explain this to you in more detail are part of our initial analysis of your enquiry.
