Financial arrangements on divorce/dissolution

What factors are considered?

When deciding financial arrangements on divorce or dissolution, a number of factors are taken into account. The priority is always the welfare of any children under the age of 18 years. There is then a statutory checklist of matters to be considered which includes the financial resources of the parties and their respective needs.

No two cases are the same and there is wide discretion as to how these factors are weighed and prioritised. Our role is to help you understand the relevance of each of these factors to your family’s circumstances and advise you in relation to the likely outcome, including:

  • Orders for the sale or transfer of property
  • Payment of lump sums
  • Sharing of pensions
  • Payment of maintenance.

Financial disclosure and transparency

An essential part of any financial settlement is full and frank financial disclosure from both parties. We will assist in the preparation and review, through to exchange of information and we will provide full advice in relation to the disclosure of your ex-partner. Our aim is to provide you with all the necessary information and tools to make confident decisions about your financial arrangements.

Negotiation, mediation and court proceedings

We aim to resolve financial matters amicably and efficiently, avoiding unnecessary conflict or court proceedings wherever possible. Our solicitors can:

  • Negotiate directly with your ex-partner or their solicitor
  • Assist you in mediation and look to use out of court settlement options (known as NCDR)
  • Robustly deal with court proceedings if they become necessary.
