FAQs

Below are some questions that we are frequently asked by clients who require advice on Property Disputes Law.

A property dispute is any type of conflict relating to “real” property – i.e. land or buildings. It can cover a wide range of issues, such as ownership, occupation, use and purchase of such property, to name only a few examples. You will sometimes hear such disputes referred to as “real property” disputes or “real estate” disputes.

We do not generally deal with disputes relating to residential planning applications or residential planning permissions.

We only directly advise on property located in England or Wales. However, we act for clients based overseas with property in the UK. We also work with lawyers in other jurisdictions, if needed.

The answer to this will depend on your specific situation, including the terms of any property agreement relating to your dispute (such as a lease). The rules and procedures regarding costs are complex and we will explain them to you in more detail as your dispute progresses.

Yes, we act for both landlord clients and tenant clients in both residential and commercial disputes.

These terms describe two different types of property ownership in England and Wales. “Leasehold” basically means a type of property which is owned under the terms of a lease (i.e. one party renting the property from another). “Freehold” land is owned outright.
